Learning Outcomes
The objectives of the course are as follows:
- To provide the students with an understanding of the competences of the EU in the field of transport and in particular in the provision of maritime services;
- To enable the students to gain knowledge of the various stages in the development of a EU maritime policy within the context of the establishment of the EU's internal market;
- To examine the relevant provisions in the Treaty on the Functioning of the EU in respect of the provision of international maritime services and the consequent secondary legislation adopted to enforce those provisions;
- To study the role of the EU plays in international maritime organizations such the IMO an in the shaping and enforcement of international maritime conventions and treaties.
Syllabus
- Introduction to the seminars - the eu’s distinct legal order – the common transport policy and maritime transport in particular;
- The eu’s external competence in the field of transport including maritime transport; cjeu caselaw; eu’s participation in the international arena;
- EU Law measures ensuring the freedom to provide maritime services within the eu and to and from the eu;
- Cabotage & short –sea shipping;
- EU measures concerning protectiveness of eu maritime undertakings; adherence to international norms for non-eu ships operating in eu waters or using eu ports – port state control.
