Learning outcomes of the curricular unit
To publicize the regime relating to five subjects of disciplinary law under the Public Functions Staff. To deepen critical reflection on legal solutions, identification and resolution of problematic issues and dogmatic and case law analysis of the same issues. Address the complex questions regarding the coexistence of different disciplinary regimes within the same public employer.
Syllabus
1. Introduction; disciplinary power: concept and foundation.
2. Disciplinary offence and duties.
3. Disciplinary penalties.
4. Disciplinary proceedings: concept, types, limitation period and procedural guarantees.
5. Impugnations.
Note: all topics covered from the perspective of the public employment relationship and the private legal-labour relationship (in the context of coexistence of regimes in the same public employer).
