Learning outcomes of the curricular unit
The main purpose of this curricular unit is to give the students a broad picture of the legal issues related to the collective labour relations (namely collective agreements, the right to strike and the participation issues) and its treatment both by the European Court of Justice and by the Portuguese Courts.
Syllabus
Trade Unions and the freedom to affiliate or not in a trade union. Collective bargaining. Collective agreements and administrative extension. Interpretation, validity, content, personal scope of collective agreements. The renegotiation of the collective agreements. The involvement of workers'representatives in the management. The termination of collective agreements. The right to strike and essential services. The interdiction of lock-out. Methods of dispute resolution: arbitration and mediation
