Learning outcomes of the curricular unit
This curricular unit aims to provide students with the necessary knowledge in order to be able to master the regulatory framework of the discrimination law within the context of employment relations. It seeks to stimulate the critical thought of the students and the awareness of having a deep and rigorous knowledge of the main concepts in this legal field. This curricular unit will not limit itself to the study of the national regulation; it will also adopt an international, European and comparative perspective in order to provide students with an integrated and comparative outlook of the legal norms regulating this subject. Thus, students should be aware of the need to articulate the national legislation with the sources of supranational law, solving possible conflicts of rules.
Syllabus
1. Anti-discrimination Law: concept, historical evolution and sources; the types of legal ban of discrimination
2. The forms of discrimination: direct, indirect, harassment, instruction to discriminate and victimization; special problems: positive action, multiple discrimination, discrimination by association and assumed discrimination
3. The main prohibited discrimination grounds: sex, age, disability and chronic illness, gender identity and sexual orientation, race, religion and belief
