Learning outcomes of the curricular unit
The purpose of this curricular unit is to get the students able to deal with Public Procurement Law and the legal principles, including Portuguese and European case-law, that apply to Public Contracts, in order to solve some of the most important problems lawyers have to deal with in this specific field of Law.
Syllabus
Part One - European Law of Public Procurement
1. Directives and other European rules and principles; from the novelties to the transposition of 2014 Diretives;
2. The European Court case law and the European Commission's interpretative documents on public procurement principles of European Law
3. Public Procurement Principles
Part Two - Public Procurement Law
1. Subjects: adjudicatory authorities;
2. Contracts concerned: public contracts;
3. Public Procurement procedures: main concepts; procedures; some case-law questions;
Part Three - The substantive regime
1. Legal concept and cathegories
2. Public powers during the contractual relationship
3. Breach of contract and its consequences
4. Contractual modification, invalidity and resolution
