Course Overview
In-depth study of the Singapore Convention on Mediation: (i) its genesis, scope, and normative architecture; (ii) the impact of its cross-border enforceability on parties’ choices, enabling them to design effective strategies for international dispute resolution and conflict management; (iii) the practical implications for lawyers, arbitrators, mediators, and other dispute resolution professionals, with particular emphasis on drafting contractual clauses and enhancing intercultural mediation skills; and (iv) the limitations and challenges arising from the still uneven adherence of States and potential formal constraints across different legal systems. The importance of the Convention as a global harmonisation tool and its effects on contemporary alternative dispute resolution practice.
