Learning outcomes of the curricular unit

Comprehension of the Portuguese system of punishment: the most important principles and the most important criminal penalties; the enforcement of these penalties; critical analysis of jurisprudencial decisions; the formulation of proposals to solve the problems. Development of skills regarding critical analysis, reflection upon problems, argumentative skills and formulation of proposals.

1.Introduction: Characterization of the Portuguese punishment system; criminal constitucional policy principles 

2. Punishment: purposes and legitimation 

3. Major penalties for singular persons and for colective persons: prison and fines/dissolution; 

4. Prison Execution: house detention; probation. Execution of the sentence of fine: 

5. Determining the degree of punishment; special cases: punishment exemption; discount; recidive, plurality of crimes and the continuous crime; 

6. Alternative penalties; 

7. Accessory penalties 

8. Security measures; 

9. "Indeterminate" punishment; 

10. The young adults Law: critical reflection and proposals for the future
