Learning outcomes of the curricular unit

Environmental law, as part of administrative law, has a paradigm of specific principles, legal sources and tools. Understanding and apprehending the scope of Environmental Law in a society of risk, of undeniable climate change and the pursuit of environmental sustainability are the goals of the course. Although its scope of application is wide, it is often dispersed, mobilising several levels of regulation. In this context, by addressing legal sources, principles and the main legal instruments, the aim is to provide students with an overall understanding of the legal-administrative framework of environmental law as an instrument for fighting climate change and pursuing sustainable development within the strategic framework of the SDGs and European environmental policy, which are the foundation of national legal regimes and national strategic objectives.

 

Syllabus

I. The context of a risk society: climate change and sustainable development.

II. The multi-level framework of environmental law: A. International law; B. European Union Law; C. Internal law;

III. The administrative paradigm of environmental law: principles and legal instruments: A. The principles and their connection to the context of the risk society; B. Legal instruments: preventive mechanisms (environmental impact assessment: strategic environmental assessment, environmental impact assessment and environmental incidence assessment; prevention of serious industrial accidents; environmental licence); the regime for the preservation of nature and biodiversity; waste management; the environmental market; sanctioning mechanisms.
