Learning outcomes of the curricular unit

Objectives: to get students acquainted with legal framework of appeals in the civil justice sistem; to provide students with a comprehensive knowledge of the scope and proceedings of appeals in civil cases.

Syllabus

1. General framework. Civil justice sistem and appeals. Superior Courts and case law in Portuguese Private Law.
2. Appeal to the Court of Appeal: grounds and procedural rules.
3. Appeal to Supreme Court: grounds and procedural rules.
4. Appeal (ordinary) with extended judgment for Uniformity of Jurisprudence; extraordinary appeal for uniformity of jurisprudence
5. Appeal in executive action;
6. Appeals to the Constitutional Court
7. Appeals in executive action; appeals in family cases and wills and probate; appeals and ADR decisions.
