Research topics
  1. Study and reflection on the issue of illegal immigrants, starting from Directive 2009/52/EC, since it adopts a fundamentally punitive perspective on the employment of third country nationals, the possibility of new sanctions against employers, namely exclusions from entitlement to some or all public benefits, aids or subsidies, how the issue of punitive damages is dealt with and protection of expelled employee when they are detained.
  2. Age discrimination, whether against younger or older people. The research will focus on age as a growing factor of inequality at work at all stages of the employment relationship. It will be coupled with the analysis of public policy and that it has to take into account the need to adjust work in the face of increasing human life span, as well as the need for fairness and solidarity between different generations.
  3. The study of the relevance of age in labor relations will also be one component of a larger project that aims to study the level of protection of social rights in Europe. This approach must take into account the international, European and Constitutional framework and its implementation in European states. This research project will be developed in coordination with the Academic Network on the European Social Charter and Social Rights, an association created under the Alsace-Moselle law and whose main mission is the promotion of the European Social Charter, the European Social Security Code and social rights in Europe, in close cooperation with the Council of Europe. In addition to research and publication, this project will also contribute to national and international court cases as amicus curia.
  4. Since our civil law is also outdated with respect to the protection of the elderly, because the protective measures provided by our law are rigid and unable to adapt to the diversity of concrete cases, another focus of the research will be the enhancement of the private autonomy of the person in need of special protection. In fact, the main concern of contemporary Portuguese Law seems to be the protection of assets, often imposing solutions whose imperative nature can and should be questioned.
